OFFICIAL RULES OF THE START WITH EMBARK CONTEST SPONSORED BY THE OREGON 529 SAVINGS BOARD

PROGRAM DESCRIPTION: The Start with Embark Contest (the "Contest") enables one family to win $529 contributed to an Embark 529 Education Savings Account.

ADMINISTRATOR: Upward Oregon

ELIGIBILITY: Eligibility is limited to legal Oregon residents who are at least 18 years of age with a valid Social Security Number or Taxpayer Identification Number ("Entrant"). Employees, directors, officers, trustees and agents (and their respective household and immediate family members, such as spouses and siblings, parents and children and their spouses) of The Bank of New York Mellon Corporation, Vestwell Administration, LLC, and their affiliates, the Oregon State Treasury, the Oregon 529 Savings Board, Upward Oregon and any of their affiliates and any promotional or marketing partners associated with the Contest (collectively, the "Contest Entities") are not eligible. Entrants must be the parent or legal guardian of any child featured in a photo.

HOW TO ENTER: To enter, recreate a photo from your own childhood with your child or children. Post your recreated photo on Instagram, Facebook, or TikTok (each, a “Platform”) using #StartWithEmbark and tagging @EmbarkSavings. Your Platform account must be public during the Contest Period so that Upward Oregon can view your entry. Entries missing the required hashtag or tag may not be considered. Entrants are responsible for ensuring their submission complies with any Platform terms of use and is visible to @EmbarkSavings.

Eligible Entrants must submit their post between November 10, 2025 at 12:00 a.m. PT and December 12, 2025 at 11:59 p.m. PT (“Contest Period”). Entries received outside of this period will not be eligible. There is a limit of one (1) entry per family. If multiple entries are submitted through one or more Platforms for the same family, all entries for that child will be disqualified. Submissions generated by a script, macro or other automated means will be disqualified. Submissions not complying with these Official Rules or incomplete entries are subject to disqualification. Upward Oregon reserves the right to disqualify any entry that is deemed inappropriate or inconsistent with the Contest’s intent. Entries MUST BE SUBMITTED no later than December 12, 2025 at 11:59 p.m. PT.

CONTENT REQUIREMENTS: Entries must be original and created by the Entrant. Photos must not:

• Contain copyrighted or trademarked material not owned or created by the Entrant.
• Contain any AI- generated material.
• Feature offensive, unsafe, or inappropriate content.
• Include individuals other than the Entrant’s child or children without the written permission of such individuals.

By entering, you confirm: (i) you are the parent or legal guardian of any minors depicted in the photo and consent to the use of their likeness for promotional purposes related to this Contest and (ii) you have written permission from anyone else who appears in the photo to use their likeness for promotional purposes related to this Contest.

PRIZES: One (1) winner will receive $529 contributed to an Embark 529 Education Savings Account (Oregon’s official 529 plan). The prize will be applied to a new or existing Embark account in the child’s name, or a beneficiary of their choice. The winner must meet all eligibility requirements for Embark account ownership and provide information required to process the contribution. If the winner does not meet Embark’s account requirements or fails to provide necessary information, an alternative winner may be selected. The prize is non-transferable, has no cash value, and may be subject to taxes or reporting requirements under applicable law.

SELECTION/VERIFICATION: All eligible entries will be reviewed for compliance, and one (1) winner will be selected in a random drawing within thirty (30) days after the Contest Period. The potential winner will be notified via direct message from @EmbarkSavings and must respond within five (5) days to confirm eligibility. If no response is received within the allotted time, an alternative winner may be selected. The odds of winning a prize in the Contest depend on the number of eligible entries received. Those not selected as winners may be presented, at the sole discretion of Upward Oregon, with additional opportunities/incentives to open an Embark account, to be accepted at their sole discretion.

CONDITIONS OF ACCEPTANCE OF PRIZE: The winner, by accepting his/her prize, agrees that he/she is responsible for (a) all federal, state and local taxes, including income taxes, if any, applicable to acceptance and use of the prize and (b) any and all costs associated with the acceptance and use of a prize, and further agrees to provide his/her Social Security Number or Federal Taxpayer Identification Number for tax reporting purposes, if requested. No transfer or substitution of the prize is permitted, except at the sole discretion of Upward Oregon.

AGREEMENT TO THE OFFICIAL RULES: By entering the Contest, each Entrant fully and unconditionally agrees to accept these Official Rules and the decisions of Upward Oregon which are final and binding in all matters related to the Contest.

CONDITIONS/RELEASE: By participating in the Contest, Entrants: (a) release the Contest Entities from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation in the Contest, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of a contribution; (b) agree to indemnify and hold each of the Contest Entities harmless from and against any and all liability for any claims, costs, injuries, losses or damages of any kind to third parties caused by Entrant's participation in the Contest; and (c) acknowledge that the Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, pertaining to the Contest. Neither the Contest Entities nor any service providers are responsible for incorrect or inaccurate transcription of Entrant information or mistakes, or for any human or other error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or web site, or any other error or malfunction, or any injury or damage to Entrant's or any other person's computer related to or resulting from participation in this Contest. By accepting a prize, a winner grants to the Sponsor the right, except where prohibited by law, to use his/her and his/her child’s name, likeness, picture, address (city and state), e-mail address, voice, biographical information, written or oral statements, for advertising and promotional purposes in promoting Embark, Sponsor, the Administrator or their websites, or this Contest or succeeding promotions, without compensation unless required by law. A winner shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of his or her (or his/her child’s) name, picture, likeness, address (city and state), e-mail address, biographical information or Official Entry Form. The rights granted under this paragraph shall extend to the Sponsor, the Administrator and their affiliated agencies or marketing partners with respect to all winners of the Contest.

CAUTION: ANY ATTEMPT BY A CONTEST ENTRANT OR ANY OTHER INDIVIDUAL TO TAMPER WITH OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR AND ITS AFFILIATES RESERVE THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Contest is not capable of being executed as planned, or unauthorized intervention, fraud, action of any Entrant, technical failure or any other cause which, in the sole opinion of the Sponsor (or Administrator), corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor (or Administrator) reserves the right, at its sole discretion, to disqualify any suspect entry or Entrant and to cancel, terminate, modify or suspend the Contest. In the event of any cancellation, termination, modification or suspension, notice of such action will be posted at Embarksavings.com, and the Sponsor (or Administrator) may, in its sole discretion, identify funding recipients from among all eligible, non-suspect submissions received as of the date of the termination, cancellation, modification or suspension.

DISPUTES: Entrants agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Entrant or any prize awarded shall be resolved individually, without resort to any form of class action. Venue and jurisdiction for any such claims or causes of action lie exclusively with the Circuit Court of Oregon for Marion County and Entrant hereby consents to the personal jurisdiction of such court; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (c) under no circumstances will an Entrant be permitted to obtain an award for, and Entrant hereby waives all rights to claim, punitive, incidental, indirect and consequential damages and any other damages other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant's rights and obligations, or the rights and obligations of the Sponsor or Administrator in connection with the Contest shall be governed by, and construed in accordance with, the laws of the State of Oregon, without giving effect to any choice of law or conflicts of law rules (whether of the State of Oregon or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Oregon.

ENTRANT'S PERSONAL INFORMATION: Any information collected online from Entrants is subject to the Embark Privacy Policy (http://www.embarksavings.com/privacy-policy ). Personal information will be used solely to administer the Contest and award the prize, in accordance with applicable privacy laws. Personal information will not be sold or used for unrelated advertising. Only parents or guardians may submit photos depicting minors.
