OFFICIAL RULES (“Official Rules”) OF THE WIN $529 EMBARK SWEEPSTAKES SPONSORED BY THE OREGON 529 SAVINGS BOARD

NO PURCHASE OR PAYMENT OF MONEY IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.

PROGRAM DESCRIPTION: The Win $529 Embark Sweepstakes (the “Sweepstakes”) enables one (1) Entrant (defined below) to win $529 contributed to an Embark 529 Education Savings Account (“Embark Account”), formerly known as an Oregon College Savings Plan account.

SPONSOR/ADMINISTRATOR: The Sweepstakes is sponsored by Oregon 529 Savings Board, 867 Hawthorne Ave SE, Salem, OR 97301 and administered by Upward Oregon, 867 Hawthorne Ave SE, Salem, OR 97301.

ELIGIBILITY: Eligibility is limited to legal residents of Oregon who are at least 18 years of age with a valid Social Security Number or Taxpayer Identification Number (“Entrant”). Employees, directors, officers, trustees and agents (and their respective household and immediate family members, such as spouses and siblings, parents and children and their spouses) of The Bank of New York Mellon Corporation, Vestwell Administration, LLC, and their affiliates, the Oregon State Treasury, the Oregon 529 Savings Board, Upward Oregon and any of their affiliates and any promotional or marketing partners associated with the Sweepstakes (collectively, the “Sweepstakes Entities”) are not eligible to enter the Sweepstakes or win a prize. Participation in the Sweepstakes is void where prohibited by law.

AGREEMENT TO THE OFFICIAL RULES: By entering the Sweepstakes, each Entrant fully and unconditionally agrees to abide by and be bound by these Official Rules and the decisions of Administrator and Sponsor, which are final and binding in all matters relating to the Sweepstakes. Winning the Prize is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER: The Sweepstakes begins on July 26, 2026 at 12:00PM PDT and ends on July 27, 2026 at 12:00AM PDT (the “Sweepstakes Period”). Eligible entrants must provide all required information on the online form located at (http://www.embarksavings.com/win529). Incomplete entry forms and entries submitted before or after the Sweepstakes Period will not be eligible. There is a limit of one (1) entry per family for entries submitted through the foregoing website. If multiple entries are submitted through the website for the same family, all entries for that family will be disqualified.

Entries generated by script, macro or other automated means or by any means that subvert the entry process, as determined in the sole discretion of Sponsor or Administrator, are void. Entries not complying with these Official Rules or incomplete entries are subject to disqualification. Administrator reserves the right to disqualify any Entry that (a) does not comply with these Official Rules, (b) is incomplete, or (c) is deemed inappropriate or inconsistent with the Sweepstakes’ intent (including, but not limited to, Entries that contain any of the following: profanity, promotion of illegal activities, content that is unlawful or otherwise in violation of or contrary to applicable laws, content that is libelous, defamatory, disparaging, tortious, slanderous or promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age, or any other basis protected by law, ordinance, or regulation). All Entries become the property of Sponsor and Administrator.

PRIZES: One (1) winner will receive $529 contributed to an Embark Account, which may be applied either to a new or an existing Embark Account in the name of the winner’s child, or a beneficiary of their choice. At the discretion of the winner, the prize may be divided and deposited in more than one Embark Account but not more than four Embark Accounts. The winner must meet all eligibility requirements for Embark Account ownership and provide information required to process the contribution. If the winner does not meet Embark Account requirements or fails to provide necessary information, such original winner will be disqualified, and an alternative winner may be selected.

The Prize is non-transferable, cannot be sold, has no cash value, and may be subject to taxes or reporting requirements under applicable law.

SELECTION/VERIFICATION: All eligible Entries will be reviewed for compliance with the Official Rules, and the winner will be selected in a random drawing conducted by Administrator within thirty (30) days of the end of the Sweepstakes Period. A random drawing will determine the winner. The selected winner will be notified by email at the email address provided in connection with the Entrant’s Entry and must respond within seven (7) days with all requested information, including a completed Claim for Prize Form, to confirm eligibility and accept the conditions of the Prize. Any selected winner who does not meet the eligibility requirements, who fails to respond within the allotted time, who fails to provide a completed Claim for Prize Form or whose Entry does not comply with the Official Rules will be disqualified. If a selected winner is disqualified, at the sole discretion of Sponsor or Administrator, an alternative winner may be selected in a random drawing from the remaining Entries. Other Entrants not selected as winners may be presented, at the sole discretion of Sponsor or Administrator, with additional opportunities/incentives to open an Embark Account, to be accepted at their sole discretion.

CONDITIONS OF ACCEPTANCE OF PRIZE: The winner, by accepting his/her Prize, agrees that he/she is responsible for (a) all federal, state and local taxes, including income taxes, if any, applicable to acceptance and use of the Prize and (b) any and all costs associated with the acceptance and use of a Prize, and further agrees to provide Sponsor and Administrator his/her Social Security Number or Federal Taxpayer Identification Number for tax reporting purposes, if requested. No transfer or substitution of the Prize is permitted, except at the sole discretion of Sponsor or Administrator.

CONDITIONS/RELEASE: By participating in the Sweepstakes, each Entrant: (a) releases Sponsor, Administrator and the Sweepstakes Entities from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by his/her participation in the Sweepstakes or from the acceptance, possession, or use or misuse of any Prize awarded or participation in any Prize-related activity, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of a contribution; (b) agrees to indemnify and hold each of Sponsor, Administrator and the Sweepstakes Entities harmless from and against any and all liability for any claims, costs, injuries, losses or damages of any kind to third parties related to the Entrant's participation in the Sweepstakes or related to the acceptance, possession, or use or misuse of the Prize awarded or participation in any Prize-related activity; and (c) acknowledges and agrees that Sponsor, Administrator and the Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, pertaining to the Sweepstakes or the Prize. None of Sponsor, Administrator, the Sweepstakes Entities or any of their respective service providers are responsible for lost, late, incomplete, illegible, inaccurate, delayed, garbled, damaged, stolen or misdirected Entries, or problems of any kind, whether mechanical, human or electronic, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, inability to access a website, inability to submit an Entry or access any online service or web site, fraud, incomplete, garbled or delayed computer or data transmissions, incorrect or inaccurate transcription of any Entrant information, whether caused by Sponsor, Administrator, any Sweepstakes Entities, users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit an Entrant’s ability to participate in the Sweepstakes, mistakes, any human or other error, omission, interruption, deletion, defect, any other error or malfunction, or any injury or damage to any Entrant's or any other person's computer related to or resulting from participation in this Sweepstakes or related to the acceptance, possession, or use or misuse of the Prize awarded or participation in any Prize-related activity. By participating in the Sweepstakes and submitting an Entry, each Entrant acknowledges and agrees that Sponsor, Administrator and the Sweepstakes Entities shall have the right to use all information, including personal information (including but not limited to, full name, birth date, address, postal code, email address, phone number, and Embark account numbers) provided in connection with an Entrant’s participation in the Sweepstakes, including through any Entry, Claim for Prize Form or otherwise (a) in connection with Sponsor and Administrator’s administration of the Sweepstakes, such as verifying the eligibility of an Entrant or the compliance of an Entry with the Official Rules, notifying winners or notifying any Entrants of a special offer in connection with the Sweepstakes and succeeding promotions or (b) to comply with applicable law, including Oregon Public Records Law, Oregon Revised Statutes 192.311 to 192.478. The rights granted under this paragraph shall extend to the Sponsor, the Administrator and their affiliated agencies or marketing partners with respect to the winner of the Sweepstakes.

CAUTION: ANY ATTEMPT BY A SWEEPSTAKES ENTRANT OR ANY OTHER INDIVIDUAL TO TAMPER WITH OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR, ADMINISTRATOR, SWEEPSTAKES ENTITIES AND THEIR AFFILIATES RESERVE THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Sweepstakes is not capable of being executed as planned, or unauthorized intervention, fraud, action of any Entrant, technical failure or any other cause which, in the sole opinion of Sponsor (and/or Administrator), corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor (and/or Administrator) reserves the right, at its sole discretion, to disqualify any suspect Entry or Entrant and to cancel, terminate, modify or suspend the Sweepstakes. In the event of any cancellation, termination, modification or suspension of the Sweepstakes, notice of such action will be posted at http://www.embarksavings.com/win529 and Sponsor (and/or Administrator) may, in its sole discretion, select potential winners from among all eligible, non-suspect submissions received as of the date of the termination, cancellation, modification or suspension of the Sweepstakes.

DISPUTES: Each Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Entrant’s participation in the Sweepstakes or any Prize shall be resolved individually, without resort to any form of class action. Venue and jurisdiction for any such claims or causes of action lie exclusively with the Circuit Court of Oregon for Marion County and each Entrant hereby consents to the personal jurisdiction of such court. Each Entrant further agrees that (a) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event include attorneys' fees; and (b) under no circumstances will an Entrant be permitted to obtain an award for, and each Entrant hereby waives all rights to claim punitive, incidental, indirect and consequential damages and any other damages (other than out-of-pocket expenses as set forth in (a)), and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, any Entrant's rights and obligations, or the rights and obligations of Sponsor, Administrator and/or any Sweepstakes Entities in connection with the Sweepstakes or any Prize shall be governed by, and construed in accordance with, the laws of the State of Oregon, without giving effect to any choice of law or conflicts of law rules (whether of the State of Oregon or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Oregon.

ENTRANT'S PERSONAL INFORMATION: Any information collected from Entrants is subject to the Embark Privacy Policy (http://www.embarksavings.com/privacy-policy). Except as otherwise noted in these Official Rules, personal information will be used solely to administer the Sweepstakes and award the Prizes, in accordance with applicable privacy laws, and personal information will not be sold or used for advertising unrelated to the Embark accounts.
